Commercial Lending

Contemporary life relies on the extension of credit, and Mike spends his days studying the provision of loans from banks and financial institutions to commercial borrowers. Accordingly, Mike is the author of the Tennessee chapter of the ABA’s best-selling treatise, Commercial Lending Law: A Jurisdiction-by-Jurisdiction Guide to U.S. and Canadian Law, (Third Edition), published in 2023. He previously co-wrote the Second Edition, published in 2016. Mike additionally co-authored the Tennessee section of The Law of Guaranties: A Jurisdiction-by-Jurisdiction Guide to U.S. and Canadian Law, likewise published by the American Bar Association, Business Law Section, and is also published on a variety of related subjects in industry periodicals, such as The Tennessee Banker. Mike is routinely engaged to modify in- and out-of-state lenders’ form commercial loan documents to comply with the requirements of Tennessee law, and regularly prepares form loan documents for lenders seeking to ensure the perfection of their security interests in collateral and to improve the quality, compliance and enforceability of their commercial lending documentation. Mike has particular experience and interest in perfecting security interests in—and enforcing remedies involving—unusual collateral such as intellectual property, aircraft, firearms, fine art and fungible assets.
